Terms of Service

These Terms of Service ("Terms") govern your use of Propfax, a construction field management and reporting platform operated by PropFax LLC ("Propfax," "we," "us," or "our").

By creating an account or using Propfax, you agree to these Terms. If you are using Propfax on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

Propfax is a B2B construction field management platform that helps contractors, owners, developers, property managers, and construction teams manage projects, generate AI-powered progress reports from photos, video, and audio, track expenses, manage proposals, collaborate with team members, and maintain project documentation. The service is available as a mobile app and a web application.

You must be at least 18 years old to use Propfax. You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for maintaining the security of your login credentials. Each user needs their own account.

Propfax offers the following subscription plans:

• Standard — $149/month. Includes a free first month. After the trial period, billing begins automatically at $149/month.
• Enterprise — $249/month, or custom agreement via sales-assisted enrollment.

Free Month (Standard Plan): New Standard subscribers receive a 30-day free trial. A valid payment method is required at signup. If you do not cancel before the trial ends, your subscription automatically converts to a paid monthly subscription at $149/month.

Monthly Renewal: Subscriptions renew automatically on a monthly basis until canceled.

Cancellation: You may cancel your subscription at any time from your account settings or by contacting support atinfo@propfaxai.com. Cancellation takes effect at the end of the current billing period. You retain access to paid features through the end of the period you have already paid for.

Payment Failure: If a payment fails, we will notify you and attempt to retry the charge. If the issue is not resolved within 7 days, we may suspend your account until a valid payment method is provided.

Service Suspension: Propfax reserves the right to suspend or restrict access to accounts with past-due balances or violations of these Terms.

Price Changes: We may change subscription prices with at least 30 days' notice via email. Continued use after a price change constitutes acceptance of the new price.

Taxes: You are responsible for any applicable taxes not collected by Stripe on our behalf.

You retain ownership of all content you upload to Propfax, including photos, videos, audio recordings, text notes, and reports.

Customer Data remains owned by the customer. Propfax processes Customer Data solely to provide, maintain, support, improve, and secure the Services.

You agree not to:

• Upload illegal, harmful, or offensive content
• Harass or threaten other team members
• Reverse engineer, decompile, or scrape Propfax
• Abuse AI features (e.g., submitting content designed to extract the underlying model)
• Share login credentials or allow others to access your account
• Use Propfax for any purpose other than legitimate construction management

AI-generated outputs may contain errors and should always be reviewed by users before being relied upon or distributed. Propfax does not guarantee the accuracy, completeness, or fitness of AI-generated content for any particular purpose.

Propfax does not provide legal, engineering, architectural, safety, accounting, estimating, code compliance, or professional advice. Users should consult qualified professionals for guidance in these areas.

Propfax relies on the following third-party services:

• Stripe — payment processing and subscription management
• Supabase — database hosting and authentication
• Anthropic (Claude API) — AI-powered report generation

Your use of these services is subject to their respective terms of service and privacy policies.

By you: You can cancel your subscription and delete your account at any time from your account settings.

By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or fail to pay for a subscription after reasonable notice.

Propfax is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, Propfax's total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email or in-app notification. Continued use of Propfax after changes take effect constitutes acceptance of the updated Terms.
